Franchisors and Franchisees Face Unique Issues

In the United States, there are more than 900,000 franchise business establishments representing 75 different industries. Franchise businesses employ more than 15 million Americans and account for 50% of all U.S. retail sales of goods and services. Not surprisingly, these businesses are mostly small businesses. In fact, franchising has become one of the most common means of operating and expanding businesses in the United States. The ABA’s Business Law section devoted their entire most recent BLT volume to the unique issues faced by both franchisors and franchisees alike, including advice for lawyers representing new franchisors, trademark and brank protection issues, and regulatory traps.
